Acceptance of terms

By creating an account or using moraCommerce, you agree to these Terms of Service. If you use the service on behalf of an organisation, you confirm you are authorised to bind that organisation to these terms.

Who we are

moraCommerce is operated by DaboLinux Technologies (Business Reg. No. BN3238495), No. 03 Ummita Plaza, Sharada, Jaen, Kano State, Nigeria.

Description of service

moraCommerce is a multi-tenant ecommerce platform providing an online storefront, an admin dashboard, a point-of-sale, inventory and multi-branch management, and related features, offered on the plans described on our Pricing page.

Accounts and eligibility

You must provide accurate information, keep your login credentials secure, and are responsible for all activity under your account. You must be able to form a binding contract and use the service only for lawful purposes.

Acceptable use

You may not use the service to:

  • Break the law or infringe the rights of others.
  • Send spam or distribute unlawful, harmful, or infringing content.
  • Attempt to breach security or access data belonging to other tenants.
  • Resell or sublicense the platform except as expressly permitted.

Fees and billing

Paid plans are billed in advance on a recurring basis as described on the Pricing page. Fees are stated exclusive of applicable taxes unless noted. Except where required by law, fees are non-refundable. Non-payment may result in suspension or downgrade after a grace period.

Customer data and content

You retain ownership of your store data and of the personal data you collect about your customers. You grant moraCommerce a limited licence to host and process that data solely to provide the service. You are responsible for having a lawful basis and appropriate privacy notices for your customers.

Data protection

Where moraCommerce processes personal data on your behalf (for example, your customers’ data), it does so as your processor under our Data Processing Addendum (DPA), which forms part of these terms and reflects our obligations under the NDPA/NDPR and GDPR. See the DPA for details, including sub-processors and security measures.

Third-party services

Payments and certain features rely on third parties (for example, Paystack, Flutterwave, and Resend). Their terms apply to those services, and we are not responsible for their acts or omissions.

Termination

You may cancel at any time. We may suspend or terminate your account for breach of these terms or non-payment. On termination we will make your data available for export for a reasonable period, after which it is deleted in line with our Privacy Policy.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, moraCommerce’s total liability arising out of or related to the service is limited to the fees you paid in the 12 months before the event giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages.

Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Kano State, Nigeria have jurisdiction over any dispute, without prejudice to any mandatory consumer protections that apply to you.

Changes to these terms

We may update these terms and will post the revised version here with a new "last updated" date. Continued use of the service after changes take effect constitutes acceptance.
